EmitenTrust.com Trust & Will Trust Company is a separately chartered Nevada trust company that can serve as a professional trustee for families, whether or not their estate plan was created on the Trust & Will platform.

SAN DIEGO, Oct. 14, 2026 /PRNewswire/ -- Trust & Will, the leader in online estate planning, today announced the launch of the Trust & Will Trust Company, a Nevada-chartered retail trust company with the legal authority to serve as a professional corporate trustee. The launch marks a defining moment for the category: the leading digital estate planning platform in the U.S. can carry out the plans it helps families create through its regulated fiduciary subsidiary.

For nearly a decade, Trust & Will has helped more than one million families start their estate plans. Now the company can step into the role that matters most at the end of the process: acting as the neutral, professional fiduciary who administers a trust when the time comes. It is the natural completion of the company's mission to help every family leave their legacy.

Trust & Will is the consumer estate planning brand of Huge Legal Technology Company, Inc. ("HLTC"). The Trust & Will Trust Company is a separate, wholly owned subsidiary of HLTC, chartered in Nevada to provide fiduciary services. It is affiliated with Trust & Will and EstateOS and is governed as its own entity. Families can use Trust & Will to create their estate plan, Trust & Will Trust Company to administer a trust, or both.

"With the Trust & Will Trust Company, we are evolving from the platform that helps families create an estate plan into the fiduciary that can carry one out," said Cody Barbo, Co-Founder and CEO of Trust & Will. "A trust deserves to be administered with the same care, technology, and transparency we bring to creating one. Now families can come to us for either job, or both."

Naming a professional, corporate trustee has long been a privilege reserved for the wealthy. Bank trust departments and traditional trust companies generally set account minimums that exclude most American families, and those that accept smaller trusts tend to focus on the long-horizon administration of funded trusts rather than the intensive work of settling a trust after a death. Everyone else falls back on a relative or friend, who inherits tax filings, meticulous records, and distribution decisions among beneficiaries who may not agree with one another, usually unpaid. The Trust & Will Trust Company exists to take on that job professionally and to do both parts of it.

"A trust holding a house, a retirement account, and a life insurance policy needs a trustee just as much as one holding millions of dollars," said Barbo. "The difference has never been the need. It has been who was willing to do the work."

Americans who take action on estate planning are increasingly choosing more comprehensive vehicles. Trust & Will's 2026 Estate Planning Report found that will ownership fell from 31% in 2025 to 26% in 2026, while trust ownership rose three percentage points over the same period.

The company's own purchase data shows the same shift, further along. Nearly 40% of members who purchase a plan directly from Trust & Will now choose a trust rather than a will, up from roughly 36% a year earlier. And since the option became available, over 11% of those trust purchasers have named Trust & Will as their trustee. More than 6,100 trusts now carry that designation, holding $6.5 billion in assets across more than 60,000 individual assets, with an average net estate value of approximately $988,000. The asset figures are likely conservative, given that many families underreport the full value of their estates.

The Trust & Will Trust Company can serve in the role a family actually needs:

  • Sole trustee: Full responsibility, start to finish.
  • Co-trustee: Alongside a family member or friend, the family still wants to be involved, taking on the technical burden while that person keeps a voice in decisions.
  • Successor trustee: Named as backup, stepping in only if a first-choice trustee cannot or will not serve.
  • Directed trustee: The family's financial advisor continues to manage investments, while the Trust & Will Trust Company handles administration, distributions, taxes, and recordkeeping.

Day to day, that work includes recordkeeping and accounting, trust tax return preparation and filing, distribution decisions made in accordance with the terms of the trust, beneficiary communication and reporting, maintaining certain assets, and coordination with a family's existing attorney, CPA, or advisor.

The directed trustee model is central to how Trust & Will works with the advisor community. Financial advisors continue to manage their clients' assets and retain those assets under management, while the Trust & Will Trust Company handles the fiduciary administration. Advisors keep the relationship and the investment mandate, families gain a professional and neutral fiduciary, and the estate plan is honored as it was written.

That builds on Trust & Will's broader investment in the professionals who serve families. Trust & Will remains the only estate planning platform that lets financial advisors sign up for free, try the platform, and upgrade to a premium experience for their clients, all without having to pick up the phone or talk to a sales representative. The fiduciary layer now sits on top of that self-serve foundation.

The trust company is chartered under the laws of the State of Nevada, one of the strongest jurisdictions in the country for trust administration. Nevada imposes no state income tax on trust income and no state inheritance tax, permits dynasty trusts lasting up to 365 years, and does not require trusts to be publicly recorded.

The Trust & Will Trust Company is open and serving families today.
